Scholars who permitted drinking of beer

Imam al-Qurtubi wrote in his Tafsir :

والجمهور من الأمة على أن ما أسكر كثيره من غير خمر العنب فمحرم قليله وكثيره ، والحد في ذلك واجب . وقال أبو حنيفة والثوري وابن أبي ليلى وابن شبرمة وجماعة من فقهاء الكوفة : ما أسكر كثيره من غير خمر العنب فهو حلال ، وإذا سكر منه أحد دون أن [ ص: 50 ] يتعمد الوصول إلى حد السكر فلا حد عليه

And the Majority of the Scholars of this held the view whatever intoxicates in large amounts, other than Khamr derived from grapes, is prohibited no matter of large or small amounts and the Hadd is a must.

And Abu Hanifah, Sufyan at-Thawri, Ibn Abi Layli, Ibn Shabrma and a group of jurists of Kufa said :

Whatever intoxicates in large amounts, other than the Khamr which is derived from grapes, is Halaal (permissible) and if someone gets intoxicated from it, without intending to drink  to the level of intoxication, then there is no Hadd over him.
